Please read these terms carefully before using the BreakOff app.
Terms of Service for BreakOff
1. Acceptance of Terms
By downloading, installing, or using the BreakOff application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
BreakOff is a digital wellness application designed to help users manage their screen time through scheduled breaks, app blocking using Apple's Family Controls and Screen Time APIs, progress tracking, and streak-based motivation. It also offers QR Code breaks, which stay locked until you re-scan a QR or barcode that you chose as a physical "unlock anchor"; an "I'm Done" break, which locks your selected apps for the remainder of the day; and an optional Friends feature for connecting with other users, sending shared phone-free break invites, and comparing progress on a leaderboard. The App is available on iOS 15.1 and later.
Commitment-style breaks. Some break types are intentionally difficult or impossible to end early. In particular, the "I'm Done" break runs until midnight and cannot be paused, ended, or overridden, and a QR Code break can only be ended by re-scanning the QR or barcode you selected when you started it. This is a deliberate part of how BreakOff helps you follow through on your intentions, please start these breaks intentionally, and keep access to your chosen QR code. App blocking never restricts the iOS Phone app or your ability to place emergency calls.
3. Eligibility
The App is rated 4+ on the App Store, but creating an account requires signing in with Apple or with Google. To create an account you must be at least 13 years old (United States), 16 years old (most EU/EEA countries), or the minimum digital-consent age in your jurisdiction if higher. Younger users may only use the App with a parent or guardian's supervision and consent. By using the App, you represent that you meet these age requirements or have appropriate supervision, and that you have the legal capacity to enter into these Terms.
Friends feature minimum age. The Friends feature, including searching for and adding friends, friend connections, break invites, the leaderboard, and the related notifications, is restricted to users 16 years of age or older regardless of jurisdiction. The first time you open Friends, we ask for your birthdate to verify this; we derive and store your age (not the birthdate) and use it only for this eligibility check. Users below the threshold are blocked from Friends; the rest of the App continues to work for them.
4. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the App, or attempt to circumvent the App's in-app purchase or subscription mechanisms.
5. User Accounts
Creating an account requires signing in with Apple (Sign in with Apple) or with Google (Sign in with Google). We use this to authenticate you, sync your settings and break history across your devices, and track your subscription entitlement. We do not ask for or store passwords.
You are responsible for maintaining the security of the Apple ID or Google account used to sign in. You may delete your account and all associated data at any time through Settings → Delete Account inside the App, or by emailing support@breakoff.io.
6. Subscriptions and Payments
Free and Pro Tiers: BreakOff offers a free tier with core features. Additional features, including repeating schedules, unlimited active breaks, and additional Emergency Breaks, are available through the BreakOff Pro auto-renewable subscription. The free tier will always remain available.
Pricing: BreakOff Pro is $4.99 per month in the United States, with a 14-day free trial available to new subscribers. Prices in other regions may vary based on local pricing tiers set by Apple. The price and trial details shown in the App at the time of purchase are the binding terms.
Billing: Subscriptions are billed through your Apple ID on the App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the rate of the selected plan.
Cancellation: You can manage and cancel your subscriptions at any time by going to your account settings on the App Store after purchase. Cancellation takes effect at the end of the current billing period, you will retain access to Pro features until then. No partial refunds are provided for unused portions of a billing period.
Refunds: All subscription purchases are processed by Apple. Refund requests must be submitted through Apple's support channels in accordance with Apple's refund policies.
Price Changes: If we change subscription pricing, we will provide notice through the App or Apple will notify you as required. Price changes will not affect your current billing period and will take effect upon your next renewal. You may cancel before the new price takes effect.
Feature Changes: We may modify, add, or remove features available in the free or Pro tiers at any time. We will make reasonable efforts to notify users of material changes to Pro features.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Use the App in any way that could damage or impair the service
Friends feature conduct. When you use Friends you also agree not to harass, threaten, impersonate, or send unwanted contact to other users, not to use a username that is offensive, infringing, or impersonates another person or organization, and not to misrepresent your age. We provide Block and Report controls inside the App; you can use them at any time to remove a user from your circle or flag content for review. We aim to review reported users and content within 24 hours. We may suspend or remove access to Friends, or to the entire App, if your conduct violates these rules.
8. Intellectual Property
The App and its original content, features, and functionality are owned by BreakOff LLC and are protected by copyright, trademark, and other intellectual property laws. The BreakOff name, logo, and all related marks are trademarks of BreakOff LLC.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. BreakOff LLC does not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is a wellness tool and is not intended as a substitute for professional medical or psychological advice.
10. Limitation of Liability
To the fullest extent permitted by law, BreakOff LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve months prior to the claim.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by updating the "Last updated" date above. Your continued use of the App after changes constitutes acceptance of the revised Terms.
12. Termination
We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Utah.
